I/We hereby agree to take
from Punjab State Electricity Board (herein-after referred to as the Board) at
the premises stated below, a supply of electrical energy not exceeding the
connected load of my/our installation as below, and I/We hereby further agree to
pay for the said supply in accordance with the relevant tariff, as amended from
time to time and also to pay for all such other charges as may become due by
me/us to the Board from time to time at rates laid down in the Schedule of
General and Service Connection Charges prescribed by the Board from time to

do so, lodge with the Local office of the Board Security Against Consumption as
per the rates specified by the PSEB in Schedule of General & Service
Connection Charges. And I/We hereby declare that we shall be bound by the
Electricity Supply Regulations including Schedules of Tariffs and Schedule of
General and Service Connection Charges approved by PSERC and also the provision
of the Electricity Act-2003 and rules & regulations made thereunder.

to supply me/us with the necessary meter/meters on hire in terms of Section 55
of Electricity Act, 2003. I/We agree to give you such security as may be
required for the price of the meter/meters whenever called upon to do so.

GUIDELINES
FOR THE PROSPECTIVE CONSUMER REGARDING
PROCESSING
OF THE CASE FOR RELEASE OF ELECTRIC CONNECTION
1. PSEB shall entertain only such prospective consumers who are ready to
take permanent connections and not those who have started construction of their
premises.
2. The applicant/consumer shall contact CC/RA to obtain an application and
agreement form at the prescribed rate.
3. The application and agreement form duly filled alongwith test report
shall be submitted to the CC./RA for further process.
4. The application and agreement form shall be checked by CC/RA in the
presence of the applicant/consumer and ensure that all the columns have been
filled in correctly and in case of any deficiency the same shall be got
completed from the applicant/consumer.
5. RA shall put up application and agreement form to the SDO/AEE/XEN(DS.)
for attestation of the photo of the applicant/consumer pasted on the form.
6. RA shall give details of amount to be deposited by the applicant/consumer
with the cashier.
7. The applicant/consumer shall deposit the required amount with the cashier
who will issue a printed receipt to the applicant/consumer in token of amount
received.
8. The applicant/consumer shall keep the original receipt with him and leave
the case file with the cashier. Formalities
on the part of the applicant/consumer shall be over.
9. The electric connection shall be released within seven days subject to
availability of material (maximum 30 days) and in case connection is not
released during this period, he may contact SDO/AEE/XEN (OP.)
10. In case of extension in load applied by the existing consumer, it shall
be considered deemed released on the day it is applied.
11. Single Phase electric connections (DS/NRS) shall be released up to 10KW
load only and above that three phase connections shall be released.

Note:- (i) The
Load of air conditioners/AC packages/centralized AC systems of standard shall be
taken as per their nameplate. For
non standard window type air conditioners the total load shall be taken as 2.5
KW.
(ii) The
load of geysers connected through power sockets only and the additional load as
per rating/name place is not to be counted for the purpose of computing the
total connected load.
(iii) The load,
motors etc. shall be counted as per the name place.

from time to time.

of the premises. The MCB shall be
provided by me/us.
vii The authorized representative of the Board can check energy consuming
apparatus/installation at my/our premises at any time.
viii There
is no other electric connection running in the above premises.

One No. DS/NRS electric connection is already existing in the above
premises and I/We want to take second connection for which I/We are ready to pay
highest slab of tariff.
ix There is no defaulting amount/theft case/pending court case of the board
against my/our above premises.
x I/We do not have any dispute of any amount with the Board anywhere in
Punjab.

AGREEMENT FOR HIGH TENSION AND EXTRA HIGH TENSION
SUPPLY
THIS
AGREEMENT MADE THIS___day of_______20__ between the Punjab State Electricity
Board(hereinafter called the 'Board' which expression shall where the context so
admits include its successors in office and assign)having its Head Office at
Patiala of the one part and____________________________________(hereinafter
called 'Consumer' which expression where the context so admits shall include his
heirs, executors, administrators , legal representatives successors in business
and assigns) of the other part.
Whereas the consumer has
requested the Board to supply him with electrical energy at his premises
situated_____________________ and indicated in red ink in the map attached
hereto for the purpose of__________and the Board has agreed to supply to the
consumer such energy upon the terms and conditions hereinafter contained.
NOW IT IS HEREBY
DECLAREDAND AGREED AS FOLLOWS:
1(a) Subject to the provisions hereinafter contained and during the
continuance of this agreement the Board shall give supply to the consumer at one
point or more, as the Board may decide for industrial/bulk/_____supply purpose,
at his premises referred to above up to a maximum demand of __________KVA(________________)
(hereinafter called contract demand) subject to provisions of condition No.23
hereof connected load of the consumer shall not exceed_______KW(____________) .
Installed capacity of the step down transformers at the premises of the consumer
shall not exceed_______KVA(____________________).
(b) The consumer shall not sell the electrical energy taken under sub
clause1(a) above, without obtaining the prior sanction in writing of the
Govt./Board.
2. The electrical energy so supplied shall be of three phase, alternating
current, at a declared pressure (voltage) of________-thousand volts between
phases and at a frequency of 50 cycles per second at the terminals. The frequency and pressure of the electricity energy at the point of
supply shall be subject to fluctuations that are ordinary, usual and incidental
to the generation and transmission of electrical energy but such fluctuations
shall not except owing to extraordinary reasons beyond the control of the Board,
exceed the tolerance limits permitted by the Indian Electricity Rules, 1956 or
any amendments/modifications thereof.
3. In case consumer gives an undertaking to take work in hand without
submitting test report and subsequently fails or neglects to obtain the supply
of electric energy from the date of readiness by Board to give supply, the
consumer shall be liable to pay to the Board from the said date the minimum
charges as laid down in the relevant schedule of tariff irrespective of the fact
that the consumer has not consumed any electric energy.
4. Unless otherwise agreed upon the point of supply shall be the outgoing
terminals of the metering equipment/circuit breaker or the cut out of the Board
installed at the consumer's/Board's premises from which electrical energy is
conveyed to the consumer.
5.(a) The Board shall provide and erect such switchgear and metering
equipment(hereinafter referred to as Board's apparatus) as may be necessary to
provide supply of power under this agreement and to measure the same.
(b) The
Board may, however, at its discretion provide metering equipment on low voltage
side of consumer's transformer and in such a case 3% shall be added to the
recorded maximum demand and units to cover transformation and cable losses.
(c) The
Board shall provide and erect such metering equipment(hereinafter called the
Board's apparatus) at its EHT sub-station as maybe necessary to afford the
supply of power under this agreement and to measure the same.
6. The consumer shall be solely responsible for and shall pay for any loss
or damage to any supply lines, main fuses, meters and/or other apparatus
belonging to the Board on the premises of the consumer whether caused
maliciously or through culpable negligence or default on the part of the
consumer or any of his employees.
7. (a)The consumer shall provide and maintain at his own cost an
accommodation (hereinafter called the consumer's Sub-Station) of a size and
construction to be approved by the Board for purpose of housing the Board's
terminal high tension switchgear and equipment.
(b)The consumer shall further provide free of cost to the Board necessary
land belonging to the consumer and afford all reasonable facilities for bringing
in not only the direct cables or overhead lines of the Board's system for
serving the consumer but also cable or overhead lines connecting Board's other
consumers and shall permit the Board to provide all requisite switchgear and
connections thereto on the above premises and to furnish supply to such other
consumers through cable and terminals situated on the consumer's premises
provided supply to the consumer in the opinion of the Board is not thereby
unduly affected.
(c)The consumer may with the written permission of the Board house his
own HT switchgear and other equipment connected with supply of energy to him
under this agreement as must necessarily be placed therein but such enclosures
shall not be used for any other purpose.
(d) The consumer shall provide and maintain at his own cost an accommodation suitable as per
requirement of the Board both in size and construction (to be approved by the
Board) for purpose of housing Board's metering arrangement nearest to the main
gate with independent access to the Board and also any other equipment including
measuring devices as may be considered necessary by the Board.
8. (a) All transformers,
switchgears and other electrical equipments belonging to the consumer directly
connected to the feeders or lines of the Board shall be of suitable design and
be maintained to the reasonable satisfaction of the Board. The settings of the fuses and relays on the consumer's control gear as
well as the rupturing capacity of any of its circuit breakers shall be subject
to the approval of the Board.
(b) In the event of any
defect(s) being discovered in consumer's installation connected to the Board's
mains or any earth or leakage occurring on any section of the circuits so
connected, the consumer, in the absence of any of the Board's authorized
employees shall immediately disconnect such part of the wiring or apparatus from
the circuits and notify the Board and the Board shall reserve the right to
disconnect at any time such sections from its supply system.
(c) The Board shall be under
no responsibility of any kind of connection with the consumer's installations or
any apparatus on the consumer's side of the supply point.
(d) The load on the three
phase of supply under the agreement shall be kept so balanced by the consumer
that the difference in current between any two phases at the time of maximum
demand shall not exceed 5% without the prior approval of the supplier in
writing.
9. The duly authorized employees of the Board shall be entitled at all
reasonable times, to enter the premises of the consumer for the purpose of
inspecting and testing his(Consumer) installation and /or for reading meter and
inspecting and testing any of apparatus belonging to the Board on consumer's
premises or for doing all things necessary or incidental to the proper giving or
maintaining supply to the consumer.
10. The Board shall not be liable for any claim for loss, damage or
compensation whatsoever arising out of failure or shortage of supply when such
failure or shortage is either directly or indirectly due to war, mutiny, civil
commotion, riot, strike, lockout, fire, flood, tempest, lightning, earthquake or
other force majeure causes or occurrences beyond the control of the Board.
11. (a) The consumer shall be
liable to pay the cost of service line and other equipment as may be laid down
or placed on his property for the purpose of supply to his premises as per the
Schedule of General and Service Connection Charges as in force at the time of
release of connection.
(b) Notwithstanding that the
cost of the full or a part of the service line has been paid for by the
consumer, the ownership thereof shall vest in the Board and will be maintained
by the Board at its cost. The Board
shall have a right to utilize the aforesaid service line and sub station in the
consumer's premises, place apparatus other than those required to control the
supply to the consumer and to lay overhead and underground feeders in the
property of the consumer with a view to connect the same with the apparatus
installed in any other consumer's premises. The consumer shall provide all necessary facilities for such a work.
12. The supply taken from the Board by the consumer under this agreement
shall be measured by the meter or meters installed by the Board at suitable
point or points. The Board shall be entitled to charge rent on account of such
metering equipment at such rates as may be in force from time to time.
13. The reading of the said meter shall be taken once in every month or at
such intervals as the Board may think expedient by the authorized
representatives of the Board. The readings so taken shall be binding and conclusive between
the consumer and the Board as to the amount of demand and electrical energy
supplied to the consumer. In case
consumer does not arrange for his representative to be available on the
scheduled date of taking the reading of the meters, the reading of meter taken
by the representatives of the Board shall be conclusive and the consumer shall
not have the right to raise any objection regarding the correctness or accuracy
of the readings. Meter readings
shall be noted in the meter card/pass book provided by the Board. The consumer shall ensure that the representative of the Board taking the
reading makes the entry in the meter card/duplicate pass book.
14. The meter shall be properly sealed by the authorized representative of
the Board in the presence of the consumer or his representative and shall not be
interfered with by the either.
15. The consumer shall be entitled on application to the Board to have a test
carried out on the meters at anytime and the expenses of such test shall be
borne by the Board or by the consumer accordingly as the meters are found
defective or correct as a result of such test. Such meters shall be deemed to be correct if the limits of the error do
not exceed those laid down in rule 57 of the Indian Electricity Rules,1956 or
any other statutory amendments/modifications thereof as maybe in force from time
to time.
16. (a) The consumer shall pay to
the Board every month charges for electrical energy supplied to the consumer
during the preceding month under this agreement in accordance with the
provisions and sale of rates set
forth in the tariff schedule as amended from time to time. The incidence of the fuel adjustment shall be in addition to any minimum
charges payable by the consumer. The
Board, if the exigencies so warrant, may change the method of charging.
(b) If the Board by
notification makes any alteration in the aforesaid scale of charges/tariff, such
altered rates shall be treated as if the same were part of this agreement in
super session of the charges set out in the schedule attached hereto with effect
from the date fixed in the notification and if no date is fixed in the
notification then from the date of issue of notification.
17. (a) If the consumer fails to
pay the amount of any bill due under this agreement within 10 days (or such
shorter period which the Board may prescribed at any time )from the date of bill
referred to, he shall be liable to pay late payment surcharge as provided in the
schedule of tariffs. If the amount of such bill remains unpaid for 10 days after
the date of its presentation, the Board shall without prejudice to its right to
recover such amount, give 15 days notice to such a person before disconnecting
the supply of electrical energy and should the supply be so disconnected, the
connection shall not be restored until full payment for all obligations pending,
including charges for the work of reconnection, has been made by the consumer. The Board may also send the notice of disconnection alongwith the bill
itself.
(b) If the payment of the bill
is not made in full, necessary surcharge for late payment of the bill as
mentioned in the relevant tariff schedule will be payable by the consumer.
18. In the event of any dispute or difference as to the correctness of any
bill or bills presented under the terms hereof, the consumer shall nevertheless
pay such bill or bills within stipulated period. Any adjustment necessary due to incorrectness in such bill or bills shall
be made by the Board in the ensuing bill(s) after the settlement of the said
dispute or difference.
19 (a) The consumer shall, when
required by the Board, pay Security Against Consumption as per schedule of
General and Service Connection Charges, as amended from time to time, for the
performance of the terms and conditions of this agreement and shall on the
requisition time to time renew or replenish SAC and security in the event of the
same becoming exhausted or insufficient. The
Board, in the event of consumer being found indulging in unauthorized use of
electricity or theft of electricity, may require him to pay additional SAC
failing which the Board may disconnect the supply to the consumer. Also the Board shall be at liberty at any time and from time to time to
appropriate and apply the SAC deposit as aforesaid towards payments or
satisfaction of all or any money which shall become due or owing by the consumer
to the Board in respect of the supply of energy or otherwise under this
agreement but the provision contained in this clause shall not prejudice any
other remedy to which the Board maybe entitled for the recovery of such amount.
(b) If the consumer fails within 15 days or such other period of notice
as may be specified in writing in each case to comply with the terms of any
notice by the Board requiring him to give any SAC or additional SAC or security
or so renew or replenish any security mentioned in sub-clause (a) foregoing,
which may become exhausted or insufficient, the Board may without prejudice to
any other remedy be entitled to refuse or discontinue the supply so long as such
failure continues.
20 (a) The consumer shall agree
to restrict or regulate consumption of electrical energy/supply under this
agreement during peak hours as may be directed by the Chief Engineer SO&C or
any other appropriate authority of the Board in writing and any other hours as
and when required to do so if the power position or any other emergency warrants
such an action.
(b) The consumer shall agree
to the supply of electricity under this agreement being curtailed, staggered or
cutoff altogether by the Board if the power position or any other emergency in
power system warrants such a course of action.
(c) The Board would have the
right to discontinue temporarily power to the consumer at any time at its
discretion, whenever it becomes necessary for the purpose of testing plant,
equipments etc. and for this no compensation will be payable to the consumer.
21. (a) The consumer shall pay to
the Board Service Connection charges, additional SAC/Security as per the
schedule of General and Service Connection Charges in force at the time of
extension of load or contract demand as the case may be.
(b) The minimum charges as
provided in the schedule of tariff shall be increased to take into account the
altered load.
22. The consumer shall not, without the previous consent in writing of the
Board, assign, transfer or part with the benefit of this agreement and shall not
in any manner part with or creates any partial or separate interest in it.
23. If at anytime during the continuance of this agreement the consumer
shall:
(a) Being a company pass a
resolution for winding up or be ordered to be wound up by a court of competent
jurisdiction and being an individual or individuals commit any act of insolvency
or be adjudged insolvent.
(b) Execute or create any
mortgage charge or other encumbrance on any property or asset of the consumer so
as to prejudicially affect the Board's electric meter, plant apparatus and
equipment, at consumer's premises or any part thereof or any right exercisable
by the Board in connection with the said electric meters, plant, apparatus and
equipment, the Board shall be at liberty to terminate this agreement by giving
15 days notice in writing to the consumer and upon such termination the consumer
shall forthwith pay to the Board all the money then due and payable under the
agreement together with a further sum equal to the amount of the minimum and/or
special guarantee for the unexpired minimum period of supply as and by way of
liquidated damages.
24. (a) The consumer shall comply
with Electricity supply Regulations prescribed by the Board and approved by
PSERC, which shall be deemed to be a part of the agreement and shall govern the
parties hereto in so far as same are applicable.
(b) The consumer shall afford
to the Board on demand all reasonable information including certified copies of
monthly return of production of goods being submitted by him to the
Central/State Excise and Sales Tax Authorities to enable the Board to keep a
watch over the consumption of electricity to keep all records required under the
provisions of Act, or the rules of the conditions of supply.
(c) If any of the information
supplied or undertaking given by the consumer is found to be incorrect or false
or shows that he had obtained connection by misrepresentation, he will be deemed
to have indulged in Un-authorized use of Electricity and will be liable to pay
higher tariff as specified by regulations by giving him a notice of 7 (seven)
days.
(d) The consumer shall not
without the prior consent of the Board effect any change in the industry or
operate any additional industry for which the connection had been taken in the
first instance. Default in this
regard may lead to unauthorized use of supply, & higher tariff as specified
in the regulations shall be payable and for non payment of the charges, the
supply shall be liable to be disconnected after giving him a notice of 15
(Fifteen) days.
(e) In the event of consumer
failing to comply with any of the provisions of the Regulations or failing to
observe and fulfill the terms and conditions of this agreement on his part, it
shall be lawful for the Board after giving notice to the consumer to discontinue
the supply of energy, notwithstanding that the Board may have at any time
previously omitted to exercise such power on a similar failure by the consumer. The Board shall however on the terms and conditions of this agreement and
on payment by the consumer of the expenses incurred by the Board in cutting off
and reconnection of the supply, reconnect the supply with reasonable speed.
25. Any levy such as Sales Tax, Electricity Duty, Octroi etc imposed by the
State Government or any other competent authorities on energy purchased by the
consumer from the Board shall be paid by the consumer.
26. This agreement shall be read and construed as subject in all respect to
the provisions of the Electricity Act, 2003 or any statutory modifications
thereof for the time being in force and the rules, regulations made there in or
any subsequent amendment or modifications thereof so far as the same
respectively may be applicable.
27. The consumer has agreed to bear stamp duty on this agreement, if
applicable.
28. The consumer shall declare the connected load of the factory at the time
of giving connection and subsequently at the time when increased demand is met
under this agreement. The consumer
shall not make any addition to the installation, unless approved by the Board.
29. All disputes arising under this agreement or touching or concerning any
covenant or conditions of this agreement shall be dealt in accordance with the
provisions of the EA-2003 and be referred to Forum of Redressal of Grievances of
the consumers.
30. The consumer would provide all corrective measures to keep the voltage
flickering within the permissible limits as maybe advised by the Board, from
time to time. Should the voltage
flicker be more than the limits prescribed by the Board, the installation shall
be disconnected and will not be reconnected, till the voltage flickering is
brought down to the satisfaction of the Board.

THIS AGREEMENT MADE THIS___day of_______20__ between
the Punjab State Electricity Board(hereinafter called the 'Board' which
expression shall where the context so admits include its successors in office
and assign)having its Head Office at Patiala of the one part

Whereas the Board has already released electric supply to the premises of

AND WHEREAS, the parties have now agreed to modify the Principal

1. In paragraph 1(a) of the Principal Agreement dated______________the

2. In paragraph 2 of the Principal Agreement the declared pressure(Voltage)

3. Subject only to the variations herein contained the Principal Agreement

AGREEMENT FOR STREET LIGHTING
(Applicable
where Initial installation of complete street light fittings and lamps and their
subsequent replacement is done at the Board's cost)
This
agreement made_________day of___________two thousand and__________between the
Punjab State Electricity Board(hereinafter referred to as "the Board"
of the one part and the Corporation/Municipal committee/Cantonment Board/Panchayat/__________
of (hereinafter together with its
successors and assigns called the consumer) of the other part.
Whereas the Board has agreed for the purpose of lighting certain street
lamps and hereinafter prescribed within the area under the jurisdiction of the
consumer to supply electrical energy (hereinafter called the supply) and to
provide for this purpose additional to the Board's general supply system the
necessary works and the said street lamps and to maintain, repair, renew and
operate the said works and renew the said lamps as hereinafter provided.
And whereas the consumer has agreed as hereinafter provided to pay for
the said supply and charges on the said works and for the renewal of said lamps.
Now
This agreement witnesseth as follows:-
1. Provisions of Fitting:-The
Board shall provide and install works consisting of conductors, insulators,
apparatus and fittings as are and maybe required for the purpose of providing
supply to the lamps mentioned in the list(Schedule-IV) and Board shall also
install such lamps as are set forth in Schedule I to this agreement. The Board shall install the initial fittings and lamps and shall also
provide subsequent replacements.
The total length of
aerial/cable lines required for providing the aforesaid supply is set forth in
Schedule II to this Agreement.
2. Location of Lamps, The
consumer shall not be entitled to demand the provision of street lamps in any
position other than upon the poles already existing unless the Board agrees to
provide extra lamps and install the necessary works.
The street light
consumer would be required to pay the actual cost of such works as per schedule
of Service connection charges.
3. Altering the position of lamps:
If the position of any lamp(s) has been agreed upon between the parties hereto
in writing or if any such lamp(s) has been installed as provided in Clause-1 and
2 above, the consumer shall not be entitled to have any change made in the
position of any such lamp(s) or to have any alteration whatsoever made thereto.
Provided that in
the event of the consumer requiring any alteration in the position or other
particulars of any such lamp(s) , the Board may execute such alteration upon
payment by the consumer of the cost thereof.
4. Type, size and luminosity of Lamps: "All
lamps shall be of the capacity not less than 25 watts and not greater than 250
watts, Lamps of 25 watts capacity may be used along roads and lanes not
accessible to vehicular tariff, but the number of such lamps shall at no time
exceed 30 percent of the total number of lamps installed. Special lamps of wattage higher than 250 may be installed as agreed to
between the parties.
The average
luminosity of batches of not less than 25 lamps in use removed at random and
tested shall at no time be less than 90 percent and 85 percent of the initial
luminosity guaranteed by the manufacturers for the vaccum and gas filled lamps
respectively, at the standard pressure for which the respective lamps are
designed. Further, the average
luminosity per watt shall not be less than that specified in the BIS
5. Lighting Hours and minimum consumption: Upon a date not later than
15 days before the commencement of each quarter beginning respectively on Ist
January, Ist April, Ist July and Ist October in each year, the consumer shall
furnish the Board with a statement showing the hours during which the consumer
requires supply for the purpose of street lighting and ensuing quarter and
provided the said statement is not in conflict with the general system of
control adopted by the Board in respect of street lighting, the Board shall
provide supply to the consumer for the purpose of street lighting for such hours
on each night as may be prescribed
by the consumer in the said statement.
Provided firstly, that in the event of lighting being required at times
other than those as above prescribed, supply may be made by the Board to the
consumer for such additional hours as may be mutually agreed upon between the
Board and the consumer in writing.
Provided secondly, that
the night period of lighting for every lamp shall be of duration not less than
an average of 8 hours over each period of one year dating from Ist April in each
year during the period of agreement.
Provided thirdly, that if the total number of units consumed in the whole
year is less than it would have been if the lamps had been lit on an average of
8 hours per night over the whole year, the Board shall charge for the difference
between the stipulated units and units actually consumed at the tariff rates.
Provided always that for the purpose of this agreement night shall mean
the period between the hours 5 p.m. to any one-day and 7 a.m. of the following
day.
6. Measurement of Energy:
The supply taken from the Board by the consumer shall be measured by the meter
or meters installed by the Board at suitable point or points and the supply
taken by the consumer so measured shall be deemed to be correct and binding on
the consumer.
Provided firstly
that in the event of consumer disputing the accuracy of any such said meter, the
consumer may, upon giving notice in writing to the Board, cause such meter to be
tested by the Board. If the meter
shall be found to be not correct as specified, the Board shall not be entitled
to recover the cost of such test from the consumer and shall adjust the
consumer's account in accordance with the result of the test with retrospective
effect for a period not exceeding three months immediately preceding the date of
such test.
Provided secondly, that if on such test as aforesaid being made by the
Board the meter shall be found to be correct as specified the Board shall be
entitled to recover from the consumer the charges as per schedule of general
charges for testing the meter.
Provided always that should the consumer decline to accept any such test
or such adjustment as aforesaid, the matter shall be referred to the DS Forum
under the Act.
7. Charges for Service and Supply of Energy: The Board shall maintain, repair and operate the
works described in clause 1 and 2 and give supply; to and renew the lamps
referred therein and in respect of the service and supply thus rendered the
consumer shall, notwithstanding anything contained in clause 13 thereof, pay the
Board at the rates prescribed in Tariff S.L. of Schedule III to this Agreement
or such rate as maybe prescribed by the PSERC.
Provided that in
the event of any lamps having been stolen or maliciously damaged by any person
or persons not proved by the consumer to be employees of Punjab State
Electricity Board, the renewal of the same shall be made at the expense of the
consumer.
The consumer shall
also pay meter hire at the rate prescribed by the Board from time to time (or as
amended from time to time) per month for every single-phase meter installed.
8. Payment of Bills:
The Board will present to the consumer monthly bills for energy consumed and for
operation, maintenance, repair and lamp renewals prescribed in clause 7above and
the said bills shall be paid on demand.
If any such bill
were not paid within 15 days of the date of presentation of the bill, a
surcharge of 10% (or as specified by PSERC) shall be levied. After one year the rate of surcharge shall be 1½% per month or part
thereof (or as specified by PSERC) until the amount is paid in full.
Provided that any such bill shall be payable within 15 days from the date
of presentation of the bill notwithstanding any difference or dispute which may
arise as to the accuracy of the bill. In
the event of an error in the bill being admitted, the amount of the error shall
be adjusted by the Board in the next monthly bill rendered to the consumer after
the settlement of the difference or dispute.
Provided further that in the event of any bill remaining unpaid for 30
days after the date of presentation of the bill the Board shall be entitled to
disconnect the supply after serving 15(Fifteen) days clear notice of its
intention to do so and to decline to reconnect the supply until all outstanding
bills due to the Board by the consumer under this agreement have been paid. In the event of the supply being so disconnected the Board shall be
entitled to charge the consumer for every day during which the supply shall have
been so disconnected at the full rates of charge prescribed in clause 7 above
with the exception of the energy charges.
Provided always that no payment shall be accepted by the Board on a
holiday declared by the Board and that in case the date on which the Board
becomes entitled to disconnect the supply is a holiday declared by the Board, it
shall postpone the disconnection of the supply till the following day.
9. Repair and Renewal of Lamps:
The Board shall repair or renew as may be deemed necessary all inoperative or
faulty lamps within 24 hours of the receipt of written notice from the consumer
in this behalf, Provided such notice has been received at the Board's local
office before 2 p.m. of any day and subject to the provision in the event of the
Board failing to repair or renew within 24 hours any inoperative or faulty lamp
of which such notice has been received, the consumer shall not be liable for the
lamp charge for such lamp for the period during which it may remain inoperative
or faulty.
10. Penalty for inefficiency:
Should the consumer consider that the provisions of clause 4 and pressure as
stated in schedule III are not complied with, he shall notify the Board in
writing and Board shall within 48 hours of the receipt of such notice rectify
the defects, failing which the Board will render itself liable to a penalty of
Rs.20/- for each day that the luminosity or pressure does not comply with the
conditions specified in clause 4 and schedule mentioned above and any dispute in
regard to the luminosity or the pressure shall be referred to the DS Forum under
the Act.
11. Applicability of Act, Rules and Regulations: The parties to this
agreement shall be bound by the provision of the Electricity Act, 2003 and any
statutory amendment thereof and of the rules made there under and of the
regulations of the Punjab State Electricity Board in so far as these maybe
relevant.
12. Commencement of Supply: The date of commencement of supply shall
be the date on which the supply is actually commenced or a date three months
after the date of notice presented to the consumer by the Board intimating that
the Board will be in a position to give supply to the consumer on or before the
said date of commencement of supply whichever is earlier.
Provided that if
the consumer does not take supply from the date when the Board is in a position
to give supply in accordance with the notice mentioned above, the consumer shall
pay to the Board charges as prescribed in Schedule of Street Lighting Tariff in
accordance with the terms of the Agreement from the date of expiry of the period
of notice referred to above till the date when he actually takes supply.
13. Duration of Agreement: This
agreement shall be and remain inforce for
five years commencing from the date of commencement of supply and be deemed to
have been renewed from time to time and shall continue in force for further
period of five years each, unless and until either party shall within the first
four years of the first or any such succeeding period of five years, have served
upon the other part 12 Calendar months notice in writing of the intention not to
renew the agreement at the expiry of the current period of five years, in which
case subject to anything contained in these presents to the contrary this
agreement shall terminate at the expiry of the period of five years during which
such notice in writing shall have been duly delivered and received by the other
party.
14. Termination of Agreement: Whenever the consumer wants permanent
disconnection of the said supply of power before the expiry of the current five
years of agreement, the consumer will have and exercise in writing the option to
pay rentals plus minimum consumption charges as maybe payable under the schedule
of tariff hereof, for the remaining period from the date of disconnection of the
street lighting supply till the agreement including arrears if any, outstanding
at the time or to pay rentals including minimum consumption charges under clause
5 hereof, until the date of lighting works erected under this agreement. In case, however, the cost of street lighting supply system or of any
portion thereof was paid by the consumer originally, then cost of erection and
dismantlement will not be payable by the consumer for such system or part
thereof as the case maybe.
15. Interruption and failure or defect in supply: The energy to be
supplied under this agreement shall be available at all hours of the day and
night, but no liability whatsoever shall attach to the Board to compensate the
consumer for any interruption, failure or defect of supply arising from any
cause whatsoever, except to the extent provided in this agreement.
16. Resolution of Disputes: In the event of any difference or dispute
arising between the Board and the consumer in respect of any matter connected
with the supply which can not be determined by these conditions or by the terms
of any agreement between the Board and the consumer and in the event of any
difference or dispute arising as to the interpretation of these conditions or of
these conditions or of the terms of the agreement between the Board and the
consumer, the matter shall be determined in accordance with the provisions of
the Act and be referred to DS Forum.

AGREEMENT FOR STREET LIGHTING
(Applicable
where Initial installation of complete street light fittings and their
subsequent replacement is carried out at the cost of the Board and initial
installation and subsequent replacement of lamps is done at consumer's cost)
This
agreement made_________day of___________two thousand and__________between the
Punjab State Electricity Board (hereinafter referred to as "the Board"
of the one part and the Corporation/Municipal committee/Cantonment Board/Panchayat/__________
of (hereinafter together with its successors and assigns called the consumer) of
the other part.
Whereas the Board has agreed for the purpose of lighting certain street
lamps and hereinafter prescribed within the area under the jurisdiction of the
consumer to supply electrical energy (hereinafter called the supply) and to
provide for this purpose additional to the Board's general supply system the
necessary works and the said street lamps and to maintain, repair, renew and
operate the said works and renew the said lamps as hereinafter provided.
And whereas the consumer has agreed as hereinafter provided to pay for
the said supply and charges on the said works and for the renewal of said lamps.
Now
this agreement witnessed as follows: -
1. Provisions of Fitting: -The
Board shall provide and install works consisting of conductors, insulators,
apparatus and fittings as are and maybe required for the purpose of providing
supply to the lamps mentioned in the list (Schedule-IV) and Board shall also
install such lamps as are set forth in Schedule I to this agreement provided
such lamps are procured and supplied by the consumer to the Board at his own
cost.
The total length of
aerial/cable lines required for providing the aforesaid supply is set forth in
Schedule II to this Agreement.
2. Location of Lamps: - The
consumer shall not be entitled to demand the provision of street lamps in any
position other than upon the poles already existing unless the Board agrees to
provide extra lamps and install the necessary works.
The street light
consumer would be required to pay the actual cost of such works as per schedule
of Service connection charges.
3. Altering the position of lamps:
If the position of any lamp(s) has been agreed upon between the parties hereto
in writing or if any such lamp(s) has been installed as provided in Clause-1 and
2 above, the consumer shall not be entitled to have any change made in the
position of any such lamp(s) or to have any alteration whatsoever made thereto.
Provided that in
the event of the consumer requiring any alteration in the position or other
particulars of any such lamp(s), the Board may execute such alteration upon
payment by the consumer of the cost thereof.
4. Type, size and luminosity of Lamps: "All
lamps shall be of the capacity not less than 25 watts and not greater than 250
watts, Lamps of 25 watts capacity may be used along roads and lanes not
accessible to vehicular tariff, but the number of such lamps shall at no time
exceed 30 percent of the total number of lamps installed. Special lamps of wattage higher than 250 may be installed as agreed to
between the parties.
The average
luminosity of batches of not less than 25 lamps in use removed at random and
tested shall at no time be less than 90 percent and 85 percent of the initial
luminosity guaranteed by the manufacturers for the vacuum and gas filled lamps
respectively, at the standard pressure for which the respective lamps are
designed. Further, the average
luminosity per watt shall not be less than that specified in the BIS
5. Lighting Hours and minimum consumption: Upon a date not later than
15(Fifteen) days before the commencement of each quarter beginning respectively
on 1st January, 1st April, 1st July and 1st
October in each year, the consumer shall furnish the Board with a statement
showing the hours during which the consumer requires supply for the purpose of
street lighting and ensuing quarter and provided the said statement is not in
conflict with the general system of control adopted by the Board in respect of
street lighting, the Board shall provide supply to the consumer for the purpose
of street lighting for such hours on each right
as may be prescribed by the consumer in the said statement.
Provided firstly, that in the event of lighting being required at times
other than those as above prescribed, supply may be made by the Board to the
consumer for such additional hours as may be mutually agreed upon between the
Board and the consumer in writing.
Provided secondly, that the night period of lighting for every lamp shall
be of duration not less than an average of 8 hours over each period of one year
dating from Ist April in each year during the period of agreement.
Provided thirdly, that if the total number of units consumed in the whole
year is less than it would have been if the lamps had been lit on an average of
8 hours per night over the whole year, the Board shall charge for the difference
between the stipulated units and units actually consumed at the tariff rates.
Provided always that for the purpose of this agreement night shall mean
the period between the hours 5 p.m. to any one-day and 7 a.m. of the following
day.
6. Measurement of Energy:
The supply taken from the Board by the consumer shall be measured by the meter
or meters installed by the Board at suitable point or points and the supply
taken by the consumer so measured shall be deemed to be correct and binding on
the consumer.
Provided firstly
that in the event of consumer disputing the accuracy of any such said meter, the
consumer may, upon giving notice in writing to the Board, cause such meter to be
tested by the Board. If the meter
shall be found to be not correct as specified, the Board shall not be entitled
to recover the cost of such test from the consumer and shall adjust the
consumer's account in accordance with the result of the test with retrospective
effect for a period not exceeding three months immediately preceding the date of
such test.
Provided secondly, that if on such test as aforesaid being made by the
Board the meter shall be found to be correct as specified, the Board shall be
entitled to recover from the consumer the charges as per schedule of general
charges for testing the meter.
Provided always that should the consumer decline to accept any such test
or such adjustment as aforesaid, the matter shall be referred to the DS Forum
under the Act.
7. Charges for Service and Supply of Energy: The Board shall maintain, repair and operate the
works described in clause 1 and 2 and give supply; to and renew the lamps
referred to therein provided such lamps are procured and provided by the
consumer to the Board at its own cost and in respect of the service and supply
thus rendered the consumer shall, notwithstanding anything contained in clause
13 thereof, pay the Board at the rates prescribed in Tariff S.L. of Schedule III
to this Agreement or such rate as maybe prescribed by the PSERC.
Provided that in
the event of any lamps having been stolen or maliciously damaged by any person
or persons not proved by the consumer to be employees of Punjab State
Electricity Board, the renewal of the same shall be made at the expense of the
consumer.
The consumer shall
also pay meter hire at the rate prescribed by the Board from time to time (or as
amended from time to time) per month for every single-phase meter installed.
8. Payment of Bills:
The Board will present to the consumer monthly bills for energy consumed and for
operation, maintenance, repair and lamp renewals prescribed in clause 7above and
the said bills shall be paid on demand.
If any such bill
were not paid within 15 days of the date of presentation of the bill, a
surcharge of 10% or as specified by PSERC shall be levied. After one year the rate of surcharge shall be 1½% per month or part
thereof or as specified by PSERC until the amount is paid in full.
Provided that any such bill shall be payable within 15(Fifteen) days from
the date of presentation of the bill notwithstanding any difference or dispute
which may arise as to the accuracy of the bill. In the event of an error in the bill being admitted, the amount of the
error shall be adjusted by the Board in the next monthly bill rendered to the
consumer after the settlement of the difference or dispute.
Provided further that in the event of any bill remaining unpaid for
30(Thirty) days after the date of presentation of the bill the Board shall be
entitled to disconnect the supply after serving 15(Fifteen) days clear notice in
writing of its intention to do so and to decline to reconnect the supply until
all outstanding bills due to the Board by the consumer under this agreement have
been paid. In the event of the supply being so disconnected the Board
shall be entitled to charge the consumer for every day during which the supply
shall have been so disconnected at the full rates of charge prescribed in clause
7 above with the exception of the energy charges.
Provided always that no payment shall be accepted by the Board on a
holiday declared by the Board and that in case the date on which the Board
becomes entitled to disconnect the supply is a holiday declared by the Board, it
shall postpone the disconnection of the supply till the following day.
9. Repair and Renewal of Lamps:
The Board shall repair or renew as may be deemed necessary all inoperative or
faulty lamps within 24 hours of the receipt of written notice from the consumer
in this behalf, Provided such notice has been received at the Board's local
office before 2 p.m. of any day alongwith requisite number of new bulbs required
to be replaced and subject to the provision in the event of the Board failing to
repair or renew within 24 hours any inoperative or faulty lamp of which such
notice has been received, the consumer shall not be liable for the lamp charge
for such lamp for the period during which it may remain inoperative or faulty.
10. Penalty for inefficiency:
Should the consumer consider that the provisions of clause 4 and pressure as
stated in schedule III are not complied with, he shall notify the Board in
writing and Board shall within 48 hours of the receipt of such notice rectify
the defects, failing which the Board will render itself liable to a penalty of
Rs.20/- for each day that the luminosity or pressure does not comply with the
conditions specified in clause 4 and schedule mentioned above and any dispute in
regard to the luminosity or the pressure shall be referred to the DS Forum under
the Act.
11. Applicability of Act, Rules and Regulations: The parties to this
agreement shall be bound by the provision of the Electricity Act, 2003 and any
statutory amendment thereof and of the rules made there under and of the
regulations of the Punjab State Electricity Board in so far as these maybe
relevant.
12. Commencement of Supply: The date of commencement of supply shall
be the date on which the supply is actually commenced or a date three months
after the date of notice presented to the consumer by the Board intimating that
the Board will be in a position to give supply to the consumer on or before the
said date of commencement of supply whichever is earlier.
Provided that if
the consumer does not take supply from the date when the Board is in a position
to give supply in accordance with the notice mentioned above, the consumer shall
pay to the Board charges as prescribed in Schedule of Street Lighting Tariff in
accordance with the terms of the Agreement from the date of expiry of the period
of notice referred to above till the date when he actually takes supply.
13. Duration of Agreement: This
agreement shall be and remain in force for five years commencing from the date
of commencement of supply and be deemed to have been renewed from time to time
and shall continue in force for further period of five years each, unless and
until either party shall within the first four years of the first or any such
succeeding period of five years, have served upon the other part 12 Calendar
months notice in writing of the intention not to renew the agreement at the
expiry of the current period of five years, in which case subject to anything
contained in these presents to the contrary this agreement shall terminate at
the expiry of the period of five years during which such notice in writing shall
have been duly delivered and received by the other party.
14. Termination of Agreement: Whenever the consumer wants permanent
disconnection of the said supply of power before the expiry of the current five
years of agreement, the consumer will have and exercise in writing the option to
pay rentals plus minimum consumption charges as maybe payable under the schedule
of tariff hereof, for the remaining period from the date of disconnection of the
street lighting supply till the agreement including arrears if any, outstanding
at the time or to pay rentals including minimum consumption charges under clause
5 hereof, until the date of lighting works erected under this agreement. In case, however, the cost of street lighting supply system or of any
portion thereof was paid by the consumer originally, then cost of erection and
dismantlement will not be payable by the consumer for such system or part
thereof as the case maybe.
15. Interruption and failure or defect in supply: The energy to be
supplied under this agreement shall be available at all hours of the day and
night, but no liability whatsoever shall attach to the Board to compensate the
consumer for any interruption, failure or defect of supply arising from any
cause whatsoever, except to the extent provided in this agreement.
16. Resolution of Disputes: In the event of any difference or dispute
arising between the Board and the consumer in respect of any matter connected

be the date on which the supply is actually commenced or a date three months
after the date of notice presented to the consumer by the Board intimating that
the Board will be in a position to give supply to the consumer on or before the
said date of commencement of supply whichever is earlier.
Provided that if
the consumer does not take supply from the date when the Board is in a position
to give supply in accordance with the notice mentioned above, the consumer shall
pay to the Board charges as prescribed in Schedule of Street Lighting Tariff in
accordance with the terms of the Agreement from the date of expiry of the period
of notice referred to above till the date when he actually takes supply.
13. Duration of Agreement: This
agreement shall be and remain in force for five years commencing from the date
of commencement of supply and be deemed to have been renewed from time to time
and shall continue in force for further period of five years each, unless and
until either party shall within the first four years of the first or any such
succeeding period of five years, have served upon the other part 12 Calendar
months notice in writing of the intention not to renew the agreement at the
expiry of the current period of five years, in which case subject to anything
contained in these presents to the contrary this agreement shall terminate at
the expiry of the period of five years during which such notice in writing shall
have been duly delivered and received by the other party.
14. Termination of Agreement: Whenever the consumer wants permanent
disconnection of the said supply of power before the expiry of the current five
years of agreement, the consumer will have and exercise in writing the option to
pay rentals plus minimum consumption charges as maybe payable under the schedule
of tariff hereof, for the remaining period from the date of disconnection of the
street lighting supply till the agreement including arrears if any, outstanding
at the time or to pay rentals including minimum consumption charges under clause
5 hereof, until the date of lighting works erected under this agreement. In case, however, the cost of street lighting supply system or of any
portion thereof was paid by the consumer originally, then cost of erection and
dismantlement will not be payable by the consumer for such system or part
thereof as the case maybe.
15. Interruption and failure or defect in supply: The energy to be
supplied under this agreement shall be available at all hours of the day and
night, but no liability whatsoever shall attach to the Board to compensate the
consumer for any interruption, failure or defect of supply arising from any
cause whatsoever, except to the extent provided in this agreement.
16. Resolution of Disputes: In the event of any difference or dispute
arising between the Board and the consumer in respect of any matter connected
with the supply which can not be determined by these conditions or by the terms
of any agreement between the Board and the consumer and in the event of any
difference or dispute arising as to the interpretation of these conditions or of
these conditions or of the terms of the agreement between the Board and the
consumer, the matter shall be determined in accordance with the provisions of
the Act and be referred to DS Forum.

SUPPLEMENTARY AGREEMENT FOR STREET LIGHTING
THIS AGREEMENT MADE THIS___day of_______20__ between
the Punjab State Electricity Board(hereinafter called the 'Board' ) of the one
part and the Corporation/ Municipal/ Cantonment
Board/ Panchayat/_________of____________(hereinafter together with its successor and assignees called the "Consumer") of the other part.
Whereas the Board has already released electric supply to the consumer
for street lighting in the area under jurisdiction of the consumer on the terms
and conditions mentioned in the agreement dated____________________hereinafter
called the Principal Agreement.
AND WHEREAS, the parties have now agreed to modify the Principal
Agreement in the manner hereinafter appearing.
AND
WHERAS this agreement is Supplemental to the Principal Agreement.
Now
this agreement witnesses and the parties hereto agree as follows:
1. In paragraph 1(a) of the Principal Agreement dated______________for
schedule-IV/drawing No.___________subsitute Schedule IV appended herewith.
2. Schedules, I,II and III appended to the Principal Agreement
dated__________shall be substituted with revised schedules, I ,II and III
appended herewith.
3. The Minimum/maximum number of lamps provided in schedule I and minimum
and maximum length of lines provided in schedule-II of the Principal Agreement
shall stand increased to those provided in revised schedules I and II appended
to this agreement.
3. Subject only to the variations herein contained the Principal Agreement
shall remain in full force and effect and shall be read and construed and be
enforceable as if terms of this agreement were inserted by way of addition or
substitution as the case may be.

2. The Board undertakes to give supply provided you remit the following
charges which are at current rates. In
case these charges are revised at the time of release of connection/load, you
would be liable to pay the difference, if any.
a) Rs._________as Service Connection Charges/Fixed and variable charges
payable as per Schedule of General and Service Connection Charges.
b) Rs.__________as balance amount of Security Against Consumption as per
Schedule of General and Service Connection Charges.
c) Rs.___________as Meter Security as per Schedule of General and Service

3. You are required to install Shunt Capacitor of_________KVAR capacity and
the details of the capacitors be indicated in the Test Report.
4. Details of Step down transformers including furnace or distribution
transformer to be Installed by HT consumers be indicated in Test Report. Clearance of Chief Electrical Inspector, Punjab allowing energisation of
transformer be attached.
5. Power of attorney in favour of duly authorized person/representative
executing the Agreement be supplied, in case of partnership firms,
registered societies and limited companies.
6. In case of Industrial connection(except falling under green category),
you are required to obtain clearance certificate from Pb. Air and Water
Pollution Control Board and furnish the same with the test report.
7. You are requested to install earth leakage protective device of suitable
capacity and indicate the same in the test report.
NOTE:- This provision is applicable for applicants availing connections at lower
voltage with power requirement of 5 KW or more or where electric power is
required for X-ray installation or luminous tube sign installation and those at
medium or high voltage.
8. Copy of Challan for having deposited Rs._______________in the treasury on
account of inspection fee of Chief Electrical Inspector be attached.
9. This demand notice is valid for the period of 2/3 months from the date of
issue. If the requisite formalities
as mentioned above are not complied within the validity period of ________months
from the date of issue of demand notice, your application shall be liable for
cancellation without serving any
further notice in this regard. However,
if you want extension in the validity period of demand notice, a request in this
regard should be made to this office up to_________ before expiry of validity
period alongwith a deposit of Rs._______as extension fee. Please note that if no such request for extension in demand notice period
is received before the date of expiry of original demand notice period, your

8. You will have the right to make appeal against the final order of

Residential Area /Predominantly residential area /Colonies of Municipal
Corporation/ Councils /Notified Area Committee/ PUDA/Improvement Trust/Village
Panchayat/ any other authority appointed under the Statute of the State.
iv) That there will not be any discharge of trade effluent from the industry
into stream or well or sewer or on the land due to its establishment or
operation or process or any treatment and disposal or an extension or addition
thereto.
v) That the industry will not use /handle/ transport/ discharge any air
pollution including noise into the atmosphere.
vi) That the industry will not discharge any toxic/hazardous wastes and
chemical
vii) That in case the industry is found to create condition that generate any
type of pollution or if there is any objection from the surrounding community
and if on verification, it is found that such objection has some substance, the
PPCB shall be free to take legal action under the provisions of water(Prevention
and Control of Pollution) Act,1974 and Air (Prevention and Control of Pollution)
Act,1981 and environment(Protection Act-1986) as considered appropriate.

AGREEMENT
FORMAT
(CABLE
TV NETWORK)
AGREEMENT BETWEEN
PUNJAB STATE ELECTRICITY BOARD
AND_____________________________
This
agreement for use of PSEB Poles to lay cable for TV Network ("The
Agreement") entered into on this____________-day of____________200__
between Punjab State Electricity Board having its headquarters at The Mall,
Patiala, Punjab, India(hereinafter referred to as the "PSEB", with
expression shall unless repugnant to the context or meaning thereof shall
include its successors and assigns), as Party of the first part,
and______________(hereinafter referred to as the "NETWORK OPERATOR",
which expression shall, unless repugnant to the context or meaning thereof
include its permitted successors
and permitted assigns), as Party of the second part.
WHEREAS,
the PSEB has installed transmission and distribution network for the
transmission and distribution of electrical energy in the State of Punjab.
WHEREAS
the Network Operators has requested the PSEB for grant of permission for using
its distribution poles for laying cables for cabled transmission/distribution of
television signals in the city of _____________(Punjab).
WHEREAS
in view of the vast benefits that would accrue to the people
in__________________(Punjab) in terms of information flow through this scheme,
PSEB has decided to permit the Network Operator to use its electricity
distribution poles for laying appropriate cable network subject to conditions
stipulated in this Agreement .
NOW
THEREFORE, in consideration of the premises and mutual covenants and conditions
set forth therein it is agreed by and between the parties as follows:-
ARTICLE-I
DEFINITIONS
1.1 DEFINITIONS: For the purpose of this Agreement:
(1) Cable: means co-axial, optical Fibre or Hybrid cable or any other device
which transmits audio, video or audio-video signals.
(2) Cable Network: means any system consisting of a set of closed
transmission paths and associated signal generation control and distribution
network, designed to provide cable service for reception by subscribers.
(3) Company: means a company as defined in section-3 of the companies
Act,1956.
(4) Franchisee: means a person licensed by the Network Operator to use his
software for providing signal to Cable Network and includes his legal heirs,
successors and executors etc. The
franchises shall hold valid registration under Cable Television
Network(Regulation), Act,1995 and rules framed thereunder as amended from time
to time.
(5) GOP: means Govt. of Punjab.
(6) Local Authority: means a Municipal Corporation, Municipal Committee,
Notified Area Committee, Gram Panchayat, Distt. Board or other authority legally
entitled to or entrusted by the Govt. with the control or management of
municipal or local fund.
(7) Network Operator; means any person who provides service through cable
network for generation and/or distribution of television signals or otherwise
controls or is responsible for the management and operation of a cable network
and includes his duly appointed "Franchisee".
(8) Person: means:-
(i) An individual who is the citizen of India.
(ii)An association of individuals or body of individuals whether
incorporated or not, whose members are Citizens of India.
(9) Programme: means an television broadcast and includes:
(i)Exhibition of films, features, dramas, advertisements and serials
through VCRs or VCPs
(ii)Audio or visuals or audit visuals live performance or presentation
and expression programming service shall be constructed accordingly.
10. PSEB:
means Punjab State Electricity Board constituted by the Govt. under section 5 of
the Electricity(Supply) Act,.1948 (DEEMED LICENSEE under EA, 2003) and shall
include its successors and assigns.
11. Subscriber: means a person who receives the signals of cable network at a
place indicated by him to the Net Work Operator without further transmitting it
to any other person.
1.2 All other words and
expressions used herein and not defined herein but defined in the Electricity
Act-2003, The Cable Television Networks (Regulation), Act 1995 and applicable to
this agreement shall have the meaning respectively assigned to them.
1.3 The heading and paragraph numbering in this Agreement are for reference
only and shall not affect the interpretation or construction of this Agreement.
1.4 Words referred to in the singular only will also include the plural and
vice versa where the context specifically requires.
1.5 Reference to natural persons includes bodies corporate and partnerships.
1.6 Reference to any agreement, enactment, ordinance or regulation includes
and amendment thereof or any replacement in the whole or in part.
1.7 Reference to Articles and Annexures are unless the context otherwise
requires, reference to Articles and Annexures of this Agreement.
ARTICLE-2
TECHNICAL TERMS
& CONDITIONS
2.1 The network operators shall abide by the terms and conditions,
regulations etc. if any, formulated by the Govt. of Punjab/India from time to
time by way of legislations, Govt. Orders etc. He shall bear all inspection
costs and fees etc. required to be deposited by duly appointed authority under
the Govt. order/legislation etc.
2.2 LAYING OF
CABLE
2.2.1 The PSEB shall allow Network Operator to string lay cab using its poles
in the city of____________. Only insulated bearer messenger wires should be
drawn by Network Operator alongwith the cables and properly clipped at regular
intervals. These wires should be
firmly fixed to the electrical poles using suitable clamps and reel insulators. At no point, the cables should be allowed to come into direct contact
with the electric poles etc. No bare conductor either in the form of wire or support wire
shall be drawn along the insulated cables. In case the insulated G.I. Wire or other support wire is to be strung to
building structures or other electricity conducting materials, necessary plastic
or porcelain insulators should be provided on the wire. The above guidelines have to be strictly adhered to during initial
installation and later on for maintenance of the cable.
2.2.2 The Network Operator shall use his own clamps and fixtures, tools and
instruments and labour for carrying/fixing cables of the TV Network to PSEB Poles. No claim whatsoever
shall be entertained by PSEB on this account. All materials(Cables , clamps, fixtures and any other hardware ) required
to be used by the Network Operator shall conform to relevant standards laid down
by Bureau of Indian Standards or as prescribed by PSEB/Punjab Govt. from time to
time.
2.2.3 All the works of stringing cables of TV network, giving individual
connections to subscribers and subsequent maintenance of the Network System
would be carried out by the Network System would be carried out by the Network
Operator, with overhead electrical line in position and being live i.e. no
shutdown of electrical lines may be provided to the Network Operator for
carrying out his work.
2.2.4 All the works required to be carried out by the Network Operator shall
conform to safety regulations and instructions issued by Electrical Inspectorate
of Govt. of Punjab or any other related agency of Govt. of Punjab/PSEB, and
shall be in line with the rules/regulations made under EA, 2003.
2.2.5 Erection of cable & subsequent maintenance and service connection
should be carried out by the person duly authorized by Chief Electrical
Inspector, Punjab to work on live, L.T.Lines only under the supervision of the
authorized personnel of the PSEB adopting all safety procedure as required for
power lines.
2.2.6 The system for laying the TV cable on the electric poles to be used by
the Network Operator will have to be got approved by him from Chief Electrical
Inspector(CEI) or any other prescribed authority.
2.3 CLEARANCES:
2.3.1 A minimum ground clearance of 3.05 metres shall be maintained by Network
Operator for the cable taken along the streets/roads.
2.3.2 A minimum clearance of 1.2 metres shall be maintained by Network Operator
between the cable and the lowest conductor of PSEB distribution lines i.e. any
functional conductor including that of the street main or any earthed conductor.
2.3.3 When the Cables are taken across the roads, the minimum ground clearance
to be maintained is 5.8 metres. Wherever
this is difficult to achieve, at the same time maintaining a minimum of 1.2
metres clearance from the lowest conductor of power line, underground cables may
be used at such road crossing after obtaining approval from the concerned local
authority, PWD/GOP. For mechanical
strength, the cable may be encased in suitable insulated pipes.
2.3.4 For Crossing Railway line, work will be carried out only after obtaining
permission of concerned Railway Authority by Network Operator at his own cost. The Network Operator would be responsible to meet with clearances and
other requirements of Railway Authorities may not allow overhead crossing of
Network Cable due to electrification of railway tracks).
2.4 INSULATION
VOLTAGE GRADE
In
order not to allow leakage of current passing into G.I. bearer wire or conductor
of the cable, consequent to any snapped power line falling on it, the PVC
insulation of the cables as well as for the insulated bearer wires shall be
graded for a voltage of not less than 650 V.
2.5 INSPECTION
The
cables and supports of the cable network shall be subject to inspection by the
PSEB officer/officials whenever necessary and Network Operator shall carry out
any improvement and modifications pointed out by them to conform with the safety
procedures as required for power lines. Necessary arrangements shall be made by
Network Operator to replace immediately and ruptured/deteriorated cable, if
pointed out by the staff of the PSEB.
2.6 LIABILITY
FOR ACCIDENTS:
2.6.1 In case of any accident to men/animals/equipments occurring due to
snapping of electric conductor over TV cable, or on account of the cable coming
into contact with any parts of the electrical installation which have become
live for any reason. PSEB shall not
be held responsible and no liability for damages/compensation what-so-ever
either by Network Operator or by any of their subscribers or general/affected
public shall lie upon PSEB. Network
Operator alone will be held responsible for any loss or damages caused to it or
to its subscribers or others in such circumstances. The Network Operator would indemnify and keep the PSEB
indemnified/protected against any such loss or compensation of claim being filed
by any third person against PSEB on account of any death/ injury or damage
occurring as a result of the act/ omission of the network operator or his agent/
employees/ assignees.
2.6.2 PSEB shall not have liability in respect of claims under Workmen
Compensation Act or otherwise made by the employees of the Network Operator
consequent to any accident during their course of employment under Network
Operator.
2.7 GENERAL
2.7.1 Network Operator shall submit plans of utilization of____poles(minimum of
100 poles and in multiples of 25 poles thereafter subject to maximum of 975
poles) to be hired to PSEB before or after signing the Agreement as per his
requirement. The plans/ sketches
shall indicate full details of the poles to be utilized viz name of the
locality/transformer(s) & route wise single line diagram of each respective
L.T.Lines emanating from 'H' Pole. Superintending
Engineer (OP) of the respective Circles shall evolve the procedure for proper
utilization/avoiding mis-utilization of poles by the Operator. For this each pole to be hired shall be properly identified &
identification mark shall be displayed by the Network Operator on respective
pole while laying the cable. Sketches
once finalized will not be changed during the financial year. Sr.Xen(Tech) shall act as Nodal Officer in case area of a Cable Operator
falls in one Circle. However, in
case Cable Operator Area falls under more than one Circle then SE/HQs shall act
as a Nodal Officers to monitor the implementation &ensure compliance of
various provisions of the agreement by the Operator.
2.7.2 Network Operator shall intimate his Schedule of Installation of cable to
concerned Superintending Engineer(s) (OP) of PSEB before commencement of the
installation work under their jurisdiction. He shall also inform concerned Sr. Executive Engineer(s)(Op) and Sub
Divisional Officer(s)(Op) of the area immediately before taking up the
installation work. Prior intimation
for taking up maintenance of
already installed network shall be given to authorized representative of
concerned SDO(s)(Op.)
2.7.3 The officers and/or workmen of the PSEB shall have the right to dismantle
and disconnect any cable, while doing maintenance work of electrical lines. Prior intimation will be given by the officer in charge to Network
Operator or his authorized representative for planned scheduled shutdown. In case the cable, in any part, is required to be removed permanently for
any bonafide purpose of the GOP/PSEB/Local authorities etc. viz City
beautification, widening of roads etc. PSEB shall be free to do so and the
Network Operator or its subscribers will not be eligible for any compensation or
other claims on that account from the PSEB. The Network Operator shall make alternative arrangements at his own cost
in such an event.
2.7.4 PSEB will not be responsible for any interruption and/or interference
caused to the quality of either or both of the video/audio signals due to the
proximity of 11 KV, 33 KV, 66 KV or other extra high tension lines to the
network cable or due to any other reason whatsoever.
2.7.5 Under no circumstances Network Operator shall interfere with the smooth
functioning of the transmission & distribution of power by the PSEB. Further, the Network Operator shall ensure that his cable TV network does
not cause any interference/impact on PSEB's communication system.
2.7.6 All the works(capital as well as maintenance) required to be carried out
by the workmen of Network Operator would be carried out only during 9.00 A.M. to
5.00 P.M.
2.7.7 In case the Network Operator uses any pole of street lighting owned by
Municipal Corporation /Committee /NAC /PUDA /Improvement Trust/ Housing Board etc. in the city / town / area, he will have to seek permission
from respective authority for its use.
2.7.8 The Network is to be laid on already installed poles of PSEB. PSEB will
not entertain any request from Network Operator for installation of additional
poles for his use.
2.7.9 In case, any LT/HT line, on which TV network cable is already laid by
Network Operator is dismantled/sifted by PSEB, no compensation /loss/ additional
expenditure whatsoever shall be paid/made good by PSEB to operate for
dismantlement/shifting of network cable by the operator. However, PSEB will give sufficient advance notice of its intention to
dismantle/shift such lines to the Network Operator.
2.7.10 The Network Operator shall arrange its own accommodation to house
communication and other associated equipment, PSEB will not under any circumstances allow the use of its infrastructure
for such type of facilities.
2.7.11 The permission to use PSEB poles by any Cable Operator shall not be
exclusive in nature i.e. one pole can be used by any number of Operators
depending upon site conditions as well as strength of the pole and PSEB shall
charge full rental charges from each Operator.
2.7.12 There should be proper identification e.g. metallic tags etc. on the
cables of the operators at each pole. Lack of proper identification mark on
cable will involve removal of cables as well as attract penal action for
unauthorized use against Cable Operators.
ARTICLE-3
COMMERCIAL
TERMS & CONDITIONS
3.1 PAYMENT:
In consideration of facilities
provided by the PSEB Network Operator shall make payment as under:
The Network Operator shall pay Rs.____________(One year charges of
Rs.300/- per pole per annum) for the financial year 2000-2001 and Rs.375/- per
Pole per annum for the financial year 2001-02) to the PSEB for utilizing minimum
100 poles & in multiple of 25 poles thereafter for running his Cable Network
in the city of__________before executing this agreement. The rental to be charged thereafter shall be decided later. In case Network Operator needs to hire more number of poles, he shall
immediately approach PSEB for permission alongwith supplementary plan &
requisite charges shall be as per terms and conditions deposited by him to PSEB.
3.2 PENALTYFOR
UNAUTHORIZED USE OF POLES:
In case at any time the operator is found using poles more than
permitted, he shall have to pay charges @ Rs.300/- per pole for the financial
year 2000-01 & Rs.375/- per pole for the financial year 2001-2002 for
minimum 25 poles or in multiple of 25 irrespective of actual number of poles
detected for the entire year of agreement & his agreement shall stand
automatically amended for the revised no. of poles for future.
3.3 FREE
FACILITIES/BENEFITS ETC.
3.3.1 BENEFITS
TO THE STATE GOVERNMENT:
a) Messages of national & social importance will be shown for the
benefit of general public.
b) Deputy Commissioner / Sr. Supdt. of Police / municipal Corp. Commissioner & others will be allowed to directly communicate through
Cable TV network.
c) The Network Operator will work very closely with the local administration
& all the local problems & information will be communicated to the
Public.
d) Government policies shall be propagated through Cable T.V.
e) Live Coverage of; important city events will be made.
f) Opportunity for local talent shall be provided.
3.3.2 BENEFIT
TO PSEB:
a) Network Operator would play PSEB's promotional material. Promotional films could be on topics such as overloading of circuits,
electrical energy conservation, guidelines for avoiding electrical accidents
& PSEB image building etc. He
would shoot edit and process PSEB commercial information free of cost. PSEB can provide list of defaulters of its electricity bills on computer
floppy & forward the same to Network Operator which will be relayed for
effecting payment. These activities
will be undertaken by Network Operator free of cost.
b) Announcement in respect of power cuts, load shedding maintenance hours
supply schedule & payment schedules etc. would also be relayed without any
charges.
c) Two exclusive channels for giving publicity material shall be at the
disposal of PSEB.
d) 600 seconds per week free time shall also be provided for social,
economic advertisement in general public interest on the main channel.
3.4 RESPONSIBILITY
FOR FINANCIAL LOSS:
Any financial loss caused to the
PSEB while installing the cable, either by damage to its property or power
failure shall be borne by Network Operator.
3.5 TERMINATION:
PSEB reserves the right to terminate the agreement even before the expiry
of the term of the agreement with three month notice, if continuance of the
agreement is felt to be prejudicial to the interest of PSEB or there has been
continuous breach of any terms & conditions of the agreement for three
months or more by the Network Operator.
3.6 VALIDITY:
The agreement shall come into force from the date of execution and shall
remain valid for the particular
financial year.
3.8 RENEWAL
OF AGREEMENT
The period of agreement shall be
for one year or less depending upon the time period left in that particular
financial year reckoned from the date of agreement. However, this may be renewed on mutually agreed terms and
conditions.
3.9 TAXES:
All
taxes/cess imposed by any Govt. authority including the local authorities will
be borne by Network Operator.
3.10 INDEMNIFICATION:
The Network Operator shall indemnify and keep harmless the PSEB, against
any expenses that may be incurred in connection with any suit or other
proceedings filed in any court of law or before any authority in respect of any
matter relating to and/or arising out of the distribution of TV signals through
the cable of the Network Operator using the Poles of the PSEB.
3.11 GENERAL:
The Network Operator may use________No. of poles as per their expressed
requirement in the city of_________. Any
additional pole required by him exclusively for his system shall be provided by
him at his own cost and PSEB shall not be liable for the same in any way. The poles can also be used by Network Operator or by its Franchisee(s)
with whom he has entered into valid Franchisee Agreement. Amount contracted for laying Cable Network shall be chargeable on lumpsum
basis without any reference or dependence on the number of poles actually used
by the Network Operator.
ARTICLE-4
ARBITRATION
4.1 INFORMATION DISPUTE RESOLUTION:
a) Each party shall designate in writing to the other party a representative
who shall be authorized to resolve any dispute arising under this agreement in
an equitable manner.
b) If the designated representatives are unable to resolve a dispute under
this agreement within 15 days, such dispute shall be referred by such
representative to a senior officer designated by the company and a Sr. Officer
designated by the PSEB respectively who shall attempt to resolve the dispute
within a further period of 15 days.
c) The parties hereto agree to use their best efforts to attempt to resolve
all disputes arising out of or in relation to this agreement promptly, equitably
and in good faith and further agree to provide each other with reasonable access
during normal business hours to any and all non privileged records, information
and data pertaining to any such dispute.
4.2 ARBITRATION:
a) in the event that any dispute is not resolved between the parties
pursuant to Article 4.1, then such dispute shall be settled exclusively and
finally by Arbitration. It is
specifically understood and agreed that any dispute that can not be resolved
between the Parties, including any matter relating to the interpretation of this
Agreement shall be submitted to Arbitration irrespective of the magnitude
thereof and the amount in dispute or whether such dispute would otherwise be
considered justifiable or ripe for resolution by any Court of Arbitral Tribunal. This Agreement and the right and obligations of the parties hereunder
shall remain in full force and effect pending the Award in such Arbitration
proceedings, which award shall
determine whether and when termination of this Agreement if relevant, shall
become effective.
b) Each Arbitration shall be conducted in accordance with Arbitration and
Reconciliation Act 1996 and subsequent amendments, if any.
c) Arbitration shall be conducted at_________.

parties against assets of the relevant party wherever those assets are located
or may be found and judgement upon any Arbitration Award may be entered by any

f) All Arbitration Awards shall be denominated in the Indian Rupees.
g) Any Arbitration proceedings or award rendered hereunder and the validity,
effect and interpretation of this Articles shall be governed by Laws in India.
4.3 CIVIL COURT JURISDICTION
For the purpose of legal proceedings in any manner connected with
arbitration agreement and arbitral proceedings/orders etc. the civil courts

AGREEMENT FOR SUPPLY OF ELECTRICITY OF
LARGE
SUPPLY INDUSTRIAL CONSUMERS GETTING
SUPPLY
FOR THEIR CLUSTER SUB-STATION
We, the following residents of__________________________ hereby agree
that we shall get electricity supply at 33 / 66 / 132 / 220 KV for the total
load/contract demand against our requisitions mentioned below:

4 I) We
jointly undertake to construct 33 / 66 / 132 / 220 KV S/Stn. with our own
sources as per feasibility clearance and thereafter shall operate and maintain
it as per Electricity Act-2003/ Rules.
ii) We also undertake
to pay jointly the service charges towards the cost of the proposed feeding
33/66/132/220KV line and the bay of PSEB. The operation and maintenance of the
line/bay done by PSEB.
iii) We undertake that we are jointly & severally responsible subject to other conditions for the payment of charges for the supply of
electricity and other charges as amended by PSEB from time to time. However,
M/s______________________ shall be our leader who will deal with PSEB for all
matters including payment of energy bill(s).
iv) We undertake not to transfer or lease out the new connection to any
other party for a period of two years after its release. In case after two years
it is proposed to transfer/lease out the connection, in the same shall be
permissible only with the prior approval of PSEB.
v) We undertake to satisfy the Board regarding our financial
capability, funding sources etc. to prove out capacity to install and run the proposed industrial unit. For this purpose, we shall submit a
copy of agreement amongst the constituent members.
vi) a) We
agree to pay all consumption based charges on the basis of readings of meters
taken by PSEB installed at our premises at the 33/66/132/220KV supply point in
the cluster sub-stations.
b) The metering at 33/66/132/220 KV shall be done by providing
electronic meters of approved make
in a separate metering room freely accessible to PSEB. 11KV Meters/Metering
equipment & CTs/PTs shall be installed in free standing meter cubicles for
each individual consumers of the cluster in the metering room. All outgoing 11KV
cables meant for feeding individual loads shall pass through these free standing
cubicles to connect up to individual 11KV meters/ metering equipment.
Specifications of meter/metering equipment shall be approved by PSEB at the time of approval of total layout of the 33/66/132/220KV
Sub-Stations prior to construction of Sub-station and errection of equipment.
c) The reading of 33 / 66 / 132 / 220 KV meter and 11KV meters
installed on individual feeders will be taken by PSEB alongwith the
representatives of cluster of consumers/CBC, PSEB. The energy charges worked out
on the basis of meter installed on 33/66/132/220KV supply point will be
apportioned in the ratio of consumption recorded on individual 11KV supply
points. The demand surcharge and power factor surcharge, if any , shall be
levied to industrial consumers on
the basis of readings recorded on 11KV feeders.
d) All the 11 KV feeders to individual constituent consumers shall be
erected by PSEB as deposit work.
The operation and maintenance of these feeders shall be done by PSEB on and
these charges leviable will be decided by Punjab State Elecy. Board for recovery
through bill on annual basis.
e) In case of any default(s) on the part of any of the constituent
consumers which warrants disconnection of the supply to his premises the disconnection shall be carried out of the defaulting consumer by opening the GO switch on the 11KV feeder.
To ensure this, a GO switch shall be provided on the individual 11KV feeder at a
point which is neither in the premises of the cluster sub-station, nor in the
premises of the individual
constituent consumer. Full co-operation for erecting the disconnection shall be
extended by PSEB.
f) In case of slowness and fastness, the consumption on all KWH meters
shall be worked out as per standing instructions. In case of dead stop and burnt 11KV meter the consumption shall be worked out on the basis of
average consumption of the preceding months or the months of the previous years
etc. as per the standing instructions. In case such consumption is not available
the same shall be worked out with the approved load factor/demand factor or ( on
the basis of working hours, if they can be properly ascertained). In all such
eventualities, the constituent consumers shall be responsible to pay the
electricity bill for the consumer recorded at 33/66/132/220KV meter.
g) The above procedure of billing may be reviewed by SE/Operation, if
the same is found to be unworkable. In such a situation, single bill be raised
on the cluster on the basis of 33/66/132/220KV meter; sharing amongst cluster
partners to be decided amongst themselves. The payment shall be made by the
leader M/s_________________________ as per provisions contained in clause(iii)
ibid.
vii) We hereby undertake to indemnity the board against any effect of
various disputes regarding supply of electricity and charges relating there to
amongst the constituent consumers.
viii) In case one of the constituent consumers is found indulging in theft of
energy or unauthorized use of electricity, that constituent consumer will be
dealt with by PSEB under the relevant provision of EA-2003 and Rules &
Regulations made there under without disrupting the supply to the remaining
constituent consumers. However, disruption to all consumers may take place. If
the consumers in the cluster do not co-operate in making the 11KV breaker off
due to default/theft etc. by that consumer.
ix) We undertake not to add any more consumer(s) to be fed from this
cluster Sub-stations without the written approval of PSEB. Due intimation of the
proposal to add replace or delete a consumer from the cluster sub-station shall
be given to PSEB, failing which all liabilities arising out of non-approval of
addition, replacement/ deletion of consumer shall lie with cluster group of
consumers.
x) The PSEB reserves the rights to inspect the cluster sub-station at
any time without giving any notice to the constituent consumers. The maintenance
staff of the cluster Sub-station,
shall, therefore, provide free access to the inspecting PSEB officials. If any
operation of the switchgear is needed by PSEB, the same shall be immediately
allowed.
xi) If a constituent consumer seeks extension in load/auxiliary load, the same may be allowed subject to no objection
from the remaining constituent consumers and technical feasibility at 11KV and
33/66KV/132/220KV as well as at the feeding mother sub-station. All relevant
charges like SAC,SCC,CD charges etc. as per PSEB schedule of service connection
charges shall have to be paid by the consumer. In case an existing constituent consumer wants a new connection in the vicinity of exiting connection, the same shall be processed separately as per
usual Commercial instructions. This may be fed from 33/66/132/220KV cluster
installation provided the constituent consumer(s) of the cluster given consent
and it is technically feasible as per decision of the competent authority like;
feasibility committee. In case of no consent and/ or no technical clearance, the
extension may not be fed from the cluster sub-station.
xii) If at any time a
constituent wants to erect his own 33/66/132/220KV Sub-station, he may be
allowed to do so subject to technical feasibility in which case due credit of
the 11KV independent line etc.

shall be given to the consumer at current market prices less the depreciation on
90% of the cost of the line etc. on straight line method, irrespective of the fact whether the line is actually dismantled or retained/used by the Board.
xiii) For issues not covered by this agreement, the cluster consumers
shall be governed by the terms and conditions as contained in the Regulations
framed by PSERC under the provisions of Electricity Act.2003.
